5. Opt-in and Consent
Kumquat Technologies Direct Communications
When a customer calls Kumquat Technologies and the call goes unanswered, a single SMS is sent to that caller as a direct response to their attempted contact. By placing the call, the customer has initiated communication, and the SMS is sent solely in response to that inbound contact.
The first message identifies Kumquat Technologies by name and informs the recipient they can reply STOP at any time to opt out of further messages. When a recipient replies STOP, they will receive a one-time confirmation and no further messages will be sent. Standard message and data rates may apply.
Customers may also initiate SMS contact by texting the Kumquat Technologies number directly, which constitutes consent to receive replies.
No unsolicited promotional or marketing messages are sent. All messages are strictly in response to customer-initiated contact.
Communications Sent on Behalf of Client Businesses
Kumquat Technologies provides an AI-powered SMS platform to service businesses. When operating on behalf of a client business, Kumquat Technologies sends SMS messages in response to missed calls received by that client business. Each client business is provisioned with their own dedicated toll-free or local phone number, registered and verified under that client business’s information in accordance with carrier and regulatory requirements. Kumquat Technologies does not use its own numbers to send messages on behalf of client businesses.
In these cases, the end business is the entity whose customers are being contacted, and that business is responsible for their own customer communications, consent practices, and privacy policies.
Messages sent on behalf of client businesses will identify the client business by name. Recipients may opt out at any time by replying STOP and will receive a one-time confirmation before all messaging ceases. Standard message and data rates may apply.
Kumquat Technologies acts as a technology platform and service provider in these cases and is not responsible for the independent privacy practices of its client businesses.
6. Opt-Out Instructions
Customers can opt out of receiving messages at any time by:
- Texting “STOP” to the kumquat number
- Texting “UNSUBSCRIBE” to the kumquat number
- Texting “CANCEL” to the kumquat number
- Texting “END” to the kumquat number
After opting out, the customer will receive a confirmation message and will no longer receive messages from kumquat.
If customers want to opt back in, they can text “START” to resume the Service.
7. Help and Support
Customers can text “HELP” for additional assistance or contact:

Message frequency: Messages are sent only in response to customer-initiated contact (missed calls or inbound texts). Customers will not receive unsolicited messages.
8. Voicemail Transcription and Email Delivery
- Every voicemail received is automatically transcribed
- Transcriptions are emailed to your business email with timestamps
- Transcriptions include searchable notes for easy reference
- Your business maintains full control of voicemail records
9. Monthly Analytics and Data Export
- Kumquat provides monthly reports of missed calls, conversations, and bookings
- Data is exported and delivered to your email
- You retain ownership of all data and reports
- Data can be exported and used for your own purposes
10. Data Retention
Kumquat retains your customer data only as long as necessary to provide the Service and generate your monthly reports. You may request deletion of specific data at any time by contacting support.
11. Data Security
We implement industry-standard security measures to protect your data, including:
- Encrypted data transmission (SSL/TLS)
- Secure storage practices
- Limited access to customer data
- Regular security updates
12. Message and Data Rates
Message and Data Rates May Apply. Customers sending or receiving text messages through kumquat may incur standard SMS charges from their wireless provider. Please contact your wireless provider for details about your specific plan and messaging rates.
13. Carrier Notice
Carriers are not liable for delayed or undelivered messages. Kumquat and your wireless carrier are not responsible for messages that are lost, delayed, or not delivered.
14. No Sharing of Opt-in Consent Data
All opt-in consent information, timestamps, and customer phone numbers will never be shared with any third parties under any circumstances, except as required by law.
